Please read these Official Rules carefully before entering the BritBox’s giveaway of signed copies of the book entitled “The Long Call” by Ann Cleeves (the “Competition”). NO PURCHASE IS NECESSARY TO ENTER OR WIN.
1. ELIGIBILITY
The Competition is open only to (i) legal residents of the United States who are eighteen (18) years of age or older at the time of entry; and (ii) legal residents of Canada (excluding residents of the Province of Quebec) who are the age of majority or older in their province or territory of residence at the time of entry. Employees (and their immediate family or those living in the same household, including their spouse, parents, siblings, and children) of BritBox, LLC, its parent company and subsidiaries, its promotional partners, divisions, parent and related companies, suppliers, printers and advertising, promotional and judging agencies are not eligible to enter or win. The Competition is subject to federal, state, and local laws and regulations and is void where prohibited by law.
2. SPONSOR
The Competition is sponsored by BritBox, LLC, located at 1120 Avenue of the Americas, Fifth Floor, New York, NY 10036-6700 (the “Sponsor”).
3. AGREEMENT TO OFFICIAL RULES
We reserve the right to make changes and update any information or Content contained within the Services and Terms without either prior notice or notice other than by revision of the Terms. Please check this page periodically for updates. Any changes to these provisions will be incorporated into revised Terms that we will post here. Changes are effective when they are posted. You have the obligation to review changes to these Terms when you access or re-access the Services. If you do not agree to, or cannot comply with the revised Terms, you must stop using the Services. Your continued use of the Services following any changes shall constitute your agreement to these Terms and a binding agreement between you and BritBox.
4. COMPETITION
Sponsor is launching a giveaway of 6 (six) signed copies of the book “The Long Call” by Ann Cleeves on Facebook and Instagram (each, a “Platform” and, collectively, the “Platforms”). There shall be 3 (three) Prizes available to win on each Platform. On each Platform, three (3) winners shall be selected to each win a Prize (as defined below) (each, a “Winner” and, collectively, the “Winners”). The odds of being selected depend on the number of eligible entries received. For the avoidance of doubt, the Competition is not sponsored, endorsed or administered by Facebook or Instagram in any capacity.
5. ENTRY PERIOD
The Competition begins on Friday, October 19th, 2021 at 12:00 PM Eastern Time (“ET”) and ends on Thursday, October 29th, 2021 at 11:59 PM ET (the “Entry Period”). You may enter this Competition by following the instructions herein. Entries received prior to or after the Entry Period will be disqualified. The use of any agencies or automated software to submit entries will void all entries submitted by that person.
6. HOW TO ENTER
You may enter this Competition on each or any of the Platforms as set out below:
(i) To enter via Facebook, you must ‘like’ the Britbox Facebook page facebook.com/BritBoxUS OR facebook.com/BritBoxCA
(ii) To enter via Instagram, you must ‘follow’ the Britbox Instagram page instagram.com/britboxtv and post your answer to the trivia question in the comments to Britbox’s official Competition post on Instagram
(each an “Entry” and together the “Entries”).
7. SELECTION
Entries will be reviewed by qualified employees or agents of Sponsor (the “Selectors”). The Selectors shall randomly select three (3) Winners from the qualifying Facebook Entries and three (3) Winners from the qualifying Instagram Entries respectively. Qualifying entries must be ‘liking’ or ‘following’ the Britbox page on the relevant platform at the time the Selectors select the Winners to be eligible. Winners will be notified that they have won a Prize by Britbox’s official account via the Platform where the entrant submitted their successful Entry. The Sponsor will make commercially reasonable attempts to notify the potential winner(s) promptly upon their selection.
8. REQUIREMENTS OF POTENTIAL WINNERS
Except where prohibited, a potential Winner may be required to complete and return a notarized affidavit of eligibility and liability/publicity release and complete a W-9 form within fourteen (14) calendar days of being notified (collectively the “Required Filings”). If a potential Winner fails to sign and return the Required Filings within the required time period, another winner will be selected as an alternate in his/her place. This process will be continued throughout until an eligible winner is able to complete the Required Filings.
Should a potential Winner(s) reside in Canada, in order to receive their Prize, the selected entrant will be required to correctly answer a time limited, mathematical skill testing question administered by telephone without assistance from any person, device or software. If the first selected entrant is unable to correctly answer the time limited skill testing question, then that entry is disqualified and the Sponsor will then select another entry, should that subsequent entry also be from a Canadian resident, the Sponsor will administer the same time limited skill testing question to that person. This process will continue until a winner is declared or the contest is cancelled.
9. PRIZES AND APPROXIMATE RETAIL VALUE
Each Winner must satisfy the Eligibility criteria set out herein and if applicable must complete the Required Filings within fourteen (14) calendar days of being notified as outlined in clause 8 above and if applicable, answer the mathematical skill testing question correctly.
Each prize consists solely of 1 (one) signed copy of the book entitled “The Long Call” by Ann Cleeves (retail value: $45 per book) (the “Prize”). There will be 6 (six) Prizes awarded across the Platforms: 3 (three) Prizes available to win via each Platform. The approximate total retail value of the each Prize is $45.00 USD. The total value of all Prizes to be awarded is $270. All federal, state, and local tax liabilities are the sole responsibility of the Winner. If applicable, Winner will be required to complete and return an IRS W-9 form (i.e. Request for Taxpayer Identification Number and Certification). The Prizes are guaranteed to be awarded. Only one Winner per household is permitted.
No cash or other substitution may be made, except by the Sponsor, who reserves the right to substitute a Prize with another prize of equal or greater value if the advertised Prize is not available for any reason as determined by the Sponsor in its sole discretion. The Winner is responsible for all taxes associated with the Prize and any travel expenses incurred in connection with receipt of the Prize. Once the Winner has been selected and notified, the Winner shall not be entitled to transfer or sell the Prize(s) to any other third party, even in the event that such third party would otherwise have been entitled to enter the Competition. The Prize is awarded “as is” and without warranty of any kind, express or implied, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose.
If a Prize notification is returned to Sponsor as undeliverable or if an entrant is found to be ineligible or declines acceptance of the Prize for any reason, an alternate Winner will be selected.
10. PRIVACY
All information submitted as part of this Competition will be treated in accordance with the Sponsor’s Privacy Policy.
11. PUBLICITY
By entering this Competition and/or accepting the Prize, Winner and entrants hereby consent (except where prohibited by law) to the use by Sponsor of the Winners’ and entrants’ name, age, photograph, voice, likeness and/or image, hometown address and content of the Entries in any media without any further payment or consideration for any future promotional activity related to this Competition.
12. GENERAL CONDITIONS
In the event that the operation, security, or administration of the Competition is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsor may, in its sole discretion, either: (a) suspend the Competition to address the impairment and then resume the Competition in a manner that best conforms to the spirit of these Official Rules; or (b) award the Prizes at random from among the eligible entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Competition or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Competition may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to any entry, the Authorized Account Holder of e-mail address used to enter will be deemed the entrant. The Authorized Account Holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain name associated with the submitted e-mail address.
13. RELEASE AND LIMITATION OF LIABILITY
BY PARTICIPATING IN THE COMPETITION, ENTRANTS AGREE TO RELEASE AND HOLD HARMLESS THE PLATFORMS (AS DEFINED HEREIN), THE SPONSOR AND EACH OF ITS RESPECTIVE AFFILIATES, SUBSIDIARIES, PARENT CORPORATIONS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AND AGENTS (THE “RELEASED PARTIES”) FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF PARTICIPATION IN THE COMPETITION OR RECEIPT OR USE OF ANY PRIZE, INCLUDING BUT NOT LIMITED TO: (a) UNAUTHORIZED HUMAN INTERVENTION IN THE COMPETITION; (b) TECHNICAL ERRORS RELATED TO COMPUTERS, SERVERS, PROVIDERS, OR TELEPHONE OR NETWORK LINES; (c) PRINTING ERRORS; (d) LOST, LATE, POSTAGE-DUE, MISDIRECTED, OR UNDELIVERABLE MAIL; (e) ERRORS IN THE ADMINISTRATION OF THE COMPETITION OR THE PROCESSING OF ENTRIES; OR (f) INJURY OR DAMAGE TO PERSONS OR PROPERTY WHICH MAY BE CAUSED, DIRECTLY OR INDIRECTLY, IN WHOLE OR IN PART, FROM ENTRANT’S PARTICIPATION IN THE COMPETITION OR RECEIPT OF ANY PRIZE. ENTRANT FURTHER AGREES THAT IN ANY CAUSE OF ACTION, THE RELEASED PARTIES’ LIABILITY WILL BE LIMITED TO THE COST OF ENTERING AND PARTICIPATING IN THE GIVEWAY, AND IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE FOR ATTORNEY’S FEES ENTRANT WAIVES THE RIGHT TO CLAIM ANY DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, PUNITIVE, CONSEQUENTIAL, DIRECT, OR INDIRECT DAMAGES.
14. DISPUTES
Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Competition or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of New York. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Released Parties in connection with the Competition, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
15. OFFICIAL RULES AND COMPETITION RESULTS
A copy of these Official Rules and the name of the Winners will be posted on the BritBox.com website for up to ninety (90) days following the conclusion of the Competition.
